1. INTRODUCTION

The following terms of use apply to WWW.BYDO.CO.UK (the “website”). This website is operated by BYDO TRADING LTD. (“Bydo”), a company registered in England and Wales under company number 12687845 and VAT registered number 351701526, which sells fashion accessories such as earrings, necklaces and rings etc. Our registered office is at 33, Gaydon Coppice Avenue, Leamington Spa, Warwickshire, CV338AF, England. Throughout the website, the terms “we,” “us” and “our” refer to Bydo. Bydo offers this website, including all information, tools, products and services available from this site, to you, the user, conditioned upon your acceptance of all the following terms (together with all other terms, conditions, policies, documents and notices expressly incorporated herein by reference, collectively the “terms of use”). Your use of this site constitutes your agreement to these terms of use.

Please read these terms and conditions carefully before ordering any products and services from Bydo Trading website or over the telephone with our customer services team. These terms will apply to any contract between us for the sale of products to you. You should print a copy of these terms and conditions or save them to your computer for future reference.

By placing an order on a Bydo website or other third party platforms authorised by Bydo, you are agreeing to be bound by these terms. If you do not accept these terms and conditions, you will not be able to order any products from us.

2. Website product image

The images of products shown on the Bydo website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflect the actual colours of our products. The product you receive may vary slightly in colour from the image on your screen. Some of the products contain natural flowers, stone, shell and pearl, which will be different to the displayed picture and it’s purely due to the nature of material and products. Please consider carefully before purchasing.

Bydo is not responsible if information made available on this website is not accurate, complete or current. The material on this website is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this website is at your own risk. This website may contain certain historical information. Historical information necessarily is not current and is provided for your reference only. We reserve the right to modify the content of this website at any time, but we have no obligation to update any information on the website. You agree that it is your responsibility to monitor changes to the website.

3. Before placing an order:

You are legally capable of entering into binding contracts; you are at least 18 years old; and you are a consumer (this means that you are an individual purchasing the products outside the course of your business or trade). You confirm and agree that all products you order are for your own private and domestic use and are not for resale. You have read and are clear about the terms and conditions.

4. Placing an order or orders:

By clicking on the “ADD TO BASKET” button, you are proceeding to the checkout page.

On this Page, you will be able to review all the products chosen and have chance to make any amendments on this order. You will need to read and accept these Sales Terms, check the total price of your order(s) and the information you have provided, and correct any input errors before confirming your order(s).

To place the order(s) successfully, you must ensure: 

Read and accept these Sales Terms;
Provide your name and address, phone number, email address, payment details and other required information;
Provide an eligible delivery address in Great Britain or Northern Ireland (see below for further details);
Be legally capable of entering into binding contracts; and
Be the owner or authorised holder of a valid debit/credit card or gift card for details of the payment methods accepted on the Bydo website.

You must check and ensure that your delivery address is correct before placing your order, as it may not be possible to change your address before the order is dispatched. Please note, once you have placed an order with us, we are unable to amend it.

All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email (sent to the email address that you have provided when placing your order) that confirms that we have received your order (the “Order Confirmation”). The contract between us (the “Contract”) will only be formed when we send you the Order Confirmation.

Bydo currently ships to all addresses within Great Britain and Northern Ireland excluding hotels, hostels, prisons, P.O. Boxes and BFPO (British Forces Post Office) addresses. We do not currently deliver to Channel Islands.

5. Processing an order or orders

Once you have submitted your order(s) using the Bydo website, our order management team will send you an email acknowledging receipt of your order(s) (“Order Receipt Confirmation”) and setting out details of the ordered Product(s).

After receiving your order(s), our sales team will carefully check your order details and ensure we dispatch the product (s) accurately. After our sales team dispatch your order, we will be sending you an email with shipping details such as delivery tracking number as well as the third party tracking website. If we are unable to supply you with a product you have ordered, for example, if the product is out of stock or because of an error in the price on our website or inability to authorise your payment, we will inform you of this by email or telephone and the contract will terminate. If you have already paid for the products, we will refund you the full amount as soon as possible. If you paid by a gift card we will issue you with a new gift card.

If you would like to amend or cancel your order before you have received your Shipment Confirmation, you must contact the Bydo customer service tean as soon as possible or as otherwise set out in the Order Receipt Confirmation. It may not be possible to amend or cancel your order, or to prevent dispatch of the Products, due to the speed with which orders are processed. If Bydo is unable to amend or cancel your order and the Products are dispatched to you, you have the option of either refusing to accept the delivery, in which case the Products will be returned to Bydo, or accepting the delivery and then returning the Products to Bydo in accordance with our Return policy. The Contract will relate only to those products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other products, which may have been part of your order until the dispatch of such products has been confirmed in a separate Dispatch Confirmation.

6. Price

When you submit your Order, you are offering to buy the Product(s) at the price set out in the Order. All prices are inclusive of VAT in the UK and are payable in Great British Pound Sterling (GBP).

Delivery charges (where applicable) and any import duty and taxes incurred will be added to the total amount due when you view the Product(s) in your Shopping Bag. The total cost for the Product(s) and any applicable delivery charges will be displayed before you confirm your Order and will be set out in the confirmatory email you receive from us.

Our prices may change at any time. If we discover that the price for a Product has changed or that there has been a pricing error when we receive your Order we will contact you and ask if you wish to proceed at the correct price. If you confirm that you do wish to proceed, please remember that we will not be under an obligation to supply the Product(s) until we have sent you the second email confirming your Order.

7. Promotions and online promotion code

While we use reasonable endeavours to estimate the demand for our promotions, all promotions are available while stocks last and are subject to availability. In the event that demand exceeds our projections, we reserve the right to withdraw the promotion at any time without notice. If you have been charged in relation to any product which we cannot fulfil as part of the promotion, your account will be refunded with the price charged. You will need to add a promotion or offer code (“Code”) in the “Voucher / Offer Code” box on the shopping bag review page of the Site. If valid, the Code will be applied. Please make sure you are aware of the following conditions:

  • 7.1 Only one code can be used per Order
  • 7.2 Codes can only be applied to full price items (Codes cannot be applied to sale items)
  • 7.3 Codes are non-transferrable and no cash alternative is available
  • 7.4 Orders must be made prior to 23:59 GMT on the closing or expiry date of the Code (if one is specified)
  • 7.5 All offers and promotions are dependent on stock availability
  • 7.6 Offer codes and promotions may be amended or removed at any time
  • 7.7 These Terms of Sale apply to purchases made using a Code

8. Payment

All payments must be made at the time of Confirmation. Payment for all Orders must be by credit or debit card. We accept various payment methods, which can be found when you place the order. Bydo Trading Ltd is currently operating in UK (United Kingdom), and only selling within UK (United Kingdom) with British Pound (£). If we are unable to accept or fulfil your Order for any reasons then we will refund any money paid by you in respect of the Order. We will not dispatch the Product(s) until we receive payment in full.

For payment by card, all credit or debit cardholders and bank account holders respectively may be dependent on authorisation and authentication. If the issuer of your payment card or our service provider refuses to, or does not for any reason authorise or validate the payment, we will not be liable in these circumstances for any delay or non-delivery in respect of the Product(s) which you have ordered as a result.

We do not hold any of your payment details anywhere on the Site. They are passed securely to our payments processor for authorisation by your bank or payment provider. You must be over the age of 18 and have a UK residential address and billing address in order to make payment successfully.

9. Delivery 

You should allow up to 5 days (excluding Sunday and bank holidays) for standard delivery (orders must be placed by 8:30pm) for in stock items. Delivery shall in any event take place within 30 days after Bydo has sent you the Shipment Confirmation. Bydo reserves the right to substitute another carrier of equal or lesser cost to deliver your order. The delivery options described above are the only shipping options available for sales through the Bydo website. Bydo is unable to accept any special delivery requests outside of the conditions covered. 

If Bydo cannot deliver your order within the period specified in your Shipment Confirmation, our customer service team will notify you as soon as possible. You may choose to cancel your order, in which case Bydo will provide you with a full refund. If you choose not to cancel your order, Bydo will endeavour to deliver your order within a reasonable period of time.

If you unreasonably defer delivery or delay the receipt of delivery after Bydo has notified you that the carrier has tried to deliver the ordered items to you, or if you have provided Bydo with an incorrect delivery address which results in an unsuccessful delivery, the delivery package will be returned to us, your order will be cancelled and a full refund will be issued to you.

10. Damaged or Defective Product(s)

You should inspect the Product(s) when you receive them for defects or damage. If you find a defect or damage contact our Customer Care Team as soon as possible with your Order reference number to hand.  If the Product(s) are found to be damaged prior to delivery to you, or defective (through no fault of your own wearing or use), we will repair or replace the Product(s) or refund the price paid by you, including any delivery charges you paid, provided that you have not worn or used and damaged the Product(s). We will either refund the cost of the return of the Product(s) to us by you.

11. Returns

You must return the Product(s) to us at your own cost within 14 days after the day of notifying us of the cancellation by contacting our customer service team, in the same condition in which you receive them (without limiting your rights to take any reasonable steps to examine the Product(s) and make sure they conform to your Order). You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right to deduct the cost of any deterioration, up to the price of the Product(s), from the refund to which you are otherwise entitled.

To return the Product(s), your item must be unused and in the same condition that you received it. You should package the parcel securely using the original packaging (making sure you include a note of your name and address  inside the parcel) and then return it to us, by hand, courier or by recorded delivery mail or other form of certified mail to the following address: “Returns Department, Bydo Trading Ltd, 33 Gaydon Coppice Avenue, Leamington Spa, Warwickshire, CV338AF, United Kingdom”.

If you cancel a Contract between us within the 7 day period, we will process the refund due to you as soon as possible and, in any case, within 14 days after the day on which we receive the Product(s) back or, if earlier, the day on which we receive evidence that you have returned the Product(s) to our returns address. We will refund the price of the Product(s) in full (except for any deduction we are entitled to make due to your use of, or damage to, the Product(s), or any unnecessary handling by you), exclusive of the cost of standard delivery. If you have selected a delivery method, which is more expensive than the standard delivery method (the cheapest option), we will only refund you the amount of the standard delivery charge. All other cancellations and refunds are at our sole discretion.

We will refund any money received from you using the same method originally used by you to pay for your purchase, unless agreed otherwise. Details of your consumer rights to cancel described above, and an explanation of how to exercise them, are provided in the delivery note, which accompanies the Product(s).

12. Personal Data

Where you have provided us with personal information, we will use this information to process your order and supply products to you. We will only use your personal information in accordance with our privacy policy, and please read them carefully before purchasing.

13. Liability

Bydo is only liable for foreseeable loss and damage. Bydo is not responsible for any loss or damage that is not foreseeable. However, nothing in these sales terms affects your legal rights as a consumer. To the full extent permitted by law, the total liability of Bydo and Bydo a/s shall be limited to the amount actually paid for the purchase of the applicable products plus delivery from the Bydo website.

In particular, nothing in these Sales Terms excludes or limits in any way the liability of Bydo:

  • for death or personal injury caused by Bydo’s negligence;
  • for fraud or fraudulent misrepresentation;
  • under section 2(3) of the UK’s Consumer Protection Act 1987 or for any breach of your consumer rights relating to products; or
  • for any matter for which it would be illegal for Bydo to limit or exclude, or attempt to limit or exclude, liability.

These terms and any claim or dispute arising in relation to a Contract will be governed by English law. You and we agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any such claim or dispute.
